This Privacy Policy governs the privacy practices for Tap Inspect, Inc. (“Tap Inspect,” “we,” “us,” or “our”), and describes how we collect, use, and share personal information when you access and/or use our website located at https://www.tapinspect.com/ (our “Site”), our mobile application, and/or our related services, offered on a software-as-a-service (SaaS) basis through our URL https://app.tapinspect.com (collectively, the “Application”).

Who Is This Policy For

Tap Inspect deals with two different groups of people, and this Privacy Policy tries to be upfront about which parts apply to each group.

If you’re a home inspection company using Tap Inspect: you’re our customer. You created an account, you’re on one of our plans, and you use our Application to run your inspection business. Most of this Privacy Policy describes what we collect from you and how we use it.

If you’re the client of one of our customers (i.e., a home inspection company), for example, you had a home inspected and received a report through Tap Inspect, you’re not our customer, but some of your information (your name, contact details, property address, and sometimes payment details) passes through our Application because your inspector uses Tap Inspect to run their business. This Privacy Policy also covers what happens to your information. If you have a question about a specific inspection, report, or charge, contact the inspection company directly. We can’t answer on their behalf or share their account, business, or inspection details with you.

Information We Collect

We comply with applicable data protection laws. We primarily have access to and/or collect information that you voluntarily give us, including the information you provided via registration, email, or other direct contact from you. We do not require you to set up a user account to use our Site, however, an account is necessary to register and use our Application. Further, to sign up as a customer of Tap Inspect, you will need to create a user account with us.

For purposes of this Privacy Policy, “Personal Information” will include all personally identifiable information that is specific to you which meets the definition of applicable data protection laws as “personal information,” “personal data,” or “personally identifiable information” (e.g., name, address, phone number, email address, etc.).

We collect the following Personal Information:

From our customers (inspection companies): account information, including name, email address, phone number, and business details, limited payment information (see the section titled Payment Information below), usage data that describes how you use our Application and Site, device and log information, and support communications when you contact us.

On behalf of our customers, about their clients: name, contact information, property address, inspection details, and (if the inspector uses Tap Inspect Payments to collect their fee) certain limited payment information (see the section titled Payment Information below). We collect this information because our customers use our Application to deliver their inspection services; we don’t collect it directly from you or for our own purposes.

Information we collect automatically: We may automatically collect the following information about your use of the Site and Application through cookies, web beacons, log files, and other technologies: domain name; browser type and operating system; pages viewed, links clicked and other activities on the Site and Application; IP address [NOTE: we are aware that some data protection laws consider an IP address to be Personal Information, and we will protect it as such to comply with such laws]; the length of time using our Site and Application; access time; and device ID or other identifiers. We may combine this information with other information that we have collected, including where applicable, Personal Information. Please see the “Cookies and Other Tracking Mechanisms” section below for more information.

Location Information: Our Application may collect and process information about the physical location of your mobile device using GPS or other location technologies, such as sensor data from your mobile device providing information about nearby Wi-Fi access points and cellular network towers (“Location Information”). You have the ability to control access to Location Information through the control settings on your device.

We collect the categories of Personal Information identified above from the following sources:

  1. directly from you;
  2. through your use of the Site and Application;
  3. through cookies and other tracking mechanisms and Location Information; and
  4. our Third-Party Providers (defined below).

Payment Information

Tap Inspect handles two separate kinds of payments, and they work differently:

Your subscription to Tap Inspect. When you pay us for your Tap Inspect subscription plan, that payment is processed through Authorize.net, with Maxio managing the underlying subscription billing. We don’t store your full card number ourselves. Instead, Authorize.net collects credit card, debit card, and bank information directly from you. Please review Authorize.net’s and Maxio’s privacy policy to learn about their privacy practices.

Payments you collect from your own clients. If you use Tap Inspect Payments to collect your inspection fee, that’s a service we offer in partnership with ProPay (a Global Payments company). ProPay is the actual payment processor: money moves between your client, ProPay’s sponsor bank, and you; we never hold or touch those funds, nor do we collect or store credit card or bank information. Using this feature requires separately accepting ProPay’s own terms. See our Payments Terms for the full breakdown of how this works and what each party is responsible for. Please review ProPay’s privacy policy to learn about its privacy practices.

Cookies and Other Tracking Mechanisms

We use cookies and other tracking mechanisms to track information about the use of our Site and Application. We may combine this information with other Personal Information we collect.

Do Not Track. Currently, our systems do not recognize browser “do-not-track” requests. You may, however, disable certain tracking as discussed in this section (e.g., by disabling cookies), and opt-out of certain ad networks.

Cookies. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Site and Application, while others are used to enable a faster log-in process or to allow us to track activities on our Site and Application. Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. Certain features of the Site and Application may not function if you disable cookies. Please see our Cookie Policy for more information about how we use cookies and your options for controlling cookies, which can be found here: https://www.tapinspect.com/cookie-policy/.

Clear GIFs, Pixel Tags and other Technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (a.k.a. web beacons, web bugs or pixel tags), in connection with our Site and Application to, among other things, track activities on the Site and Application, help us manage content, and compile statistics about usage of the Site and Application. We also use clear GIFs in HTML e-mails to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.

Third-Party Analytics. We use automated devices and applications on the Site and Application, such as Google Analytics, to evaluate usage of our Site and Application. We also may use other analytic means to evaluate our Site and Application. We use these tools to help us improve our Site and Application, performance, and user experiences. These entities may use cookies and other tracking technologies to perform their services. You can learn more about Google Analytics cookies by clicking here and about how Google protects your data by clicking here. You can prevent the use of Google Analytics relating to your use of our Site by downloading and installing a browser plugin available here: https://tools.google.com/dlpage/gaoptout.

If you wish to limit third parties’ collection of information about your use of our Site or Application, some of these third parties permit you to opt-out of such advertising through the Digital Advertising Alliance or Network Advertising Initiative in the U.S., or the Digital Advertising Alliance of Canada in Canada. Other third parties offer their own opt-out option, which you may exercise at your discretion.

For as long as we have your Personal Information, we will continue to protect the privacy and security of such Personal Information consistent with the Privacy Policy.

We keep your account data and your clients’ inspection reports for as long as your account is active, and, importantly, we don’t delete your reports when you cancel. Once cancelled, you (and your clients, for reports already shared with them) can still access previously published reports and your historical data; you just won’t be able to publish or share new ones, or update old ones, until you re-subscribe. See our Refund & Cancellation Policy.

If you’d rather delete your account and data entirely, you may request deletion from the Application or your web account (see our help center guide). We’ll send a confirmation email from info@tapinspect.com, and your account and everything in it is permanently deleted 30 days later, unless we are required to keep such data for legal purposes.

Please note that if we elect to de-identify your Personal Information, such de-identified information is no longer your Personal Information, and we may use such de-identified information, alone or in an aggregated basis to analyze and offer our Application and Site, or as we deem appropriate.

We use appropriate administrative, technical, and physical safeguards to protect your Personal Information in our systems, including encryption for data in transit and at rest. We restrict access to your Personal Information to our authorized personnel and/or Third-Party Providers as appropriate and necessary to provide our Site and Application and/or maintain your user account. The computers/servers in which we store Personal identifiable Information are kept in a secure environment.

However, no website, database, or system is completely secure or “hacker proof.” You are also responsible for taking reasonable steps to protect your Personal Information against unauthorized disclosure or misuse and protecting your user credentials for your account as we are not liable for any unauthorized use of such user credentials. If we ever experience a breach affecting your information, we’ll notify you by email to the address on your account, without unreasonable delay.

If you’re an inspection company and you believe your clients’ payment card data may have been compromised on your end, please tell us right away at info@tapinspect.com. We’ll acknowledge your report within 1 business day. See the Payments Terms for more on this.
